How patent filing fees work in India

Patent filing fees in India are prescribed in the Patents Rules First Schedule. At application stage, Form 1 covers the basic filing for a specification up to 30 pages and 10 claims. Additional government fees apply for each extra page or claim, for each priority claimed in a convention application, and for optional requests such as early publication (Form 9) and request for examination (Form 18).

E-filing rates on the IP India portal are lower than physical filing. This calculator uses e-filing Tier 1 rates for individuals, DPIIT-recognised startups, and small entities, and Tier 2 rates for large entities. Confirm your applicant category on the official fee page before payment.

Government fees are only part of the total cost of obtaining a patent. Professional fees for drafting, filing support, and responding to examination reports are separate and vary by firm and complexity.

Who qualifies for lower patent fees?

Natural persons, startups recognised under Startup India, and small entities typically pay the lower Tier 1 schedule when filing electronically. Large entities and others pay Tier 2 rates. Form 28 and supporting declarations may be required to claim startup or small-entity status.

Use this calculator for budgeting and client estimates, then verify the exact payable amount on ipindia.gov.in at the time of filing. Fee schedules can be updated when the Controller General publishes revised First Schedule figures.
